‘Stand Your Grand’ Plea Failed Marissa Alexander With 20 Year Sentence, But Now She Gets A New Trial

Marissa Alexander on the newsMarissa Alexander , The Florida women  was sentenced to 20 years in prison after discharging a gun into the ceiling of her Florida home, as a warning shot for her husband that she feared, is getting a new trial! Alexander attempted to use the same “Stand Your Ground” defense that protected George Zimmerman, but it failed her despite no physical harm done to anyone in her case. The jury took a mere 12 minutes to convict Alexander.

It’s being reported that Alexander was sentenced under the “10-20-Life” law, which carries a series of mandatory minimum sentences related to gun crimes. The prosecutor in Marissa’s case was Angela Corey, the same woman who also prosecuted Zimmerman.

The judge involved in the case, Judge James J. Daniel is saying the jury’s instructions on self-defense were incorrect. “We reject her contention that the trial court erred in declining to grant her immunity from prosecution under Florida’s Stand Your Ground law,” wrote Judge Daniel, “but we remand for a new trial because the jury instructions on self-defense were erroneous.”

Marissa’s ordeal sounds like self-defense to us:

Alexander, who had given birth the week before, testified that after an altercation regarding texts from her ex-husband, she locked herself in the bathroom. Her husband Rico Gray broke through the door, grabbed her by the neck, and shoved her into the door. She ran to the garage, found she couldn’t get the door open, and returned with a gun. When Gray saw the gun, he said, “Bitch, I’ll kill you.” Alexander testified that firing the gun into the air as a warning shot was “the lesser of two evils.”

We’re glad Marissa is getting another chance at justice.
