A drummer is suing MTV and Viacom over their Nicki Minaj documentary “My Time Now” for unlawfully using his image. Michael Savely, a private drum tutor and street performer, claims his tutoring business has suffered as a result of it.

Savely was filmed in November 2010 by the show’s producers, but refused to sign a waiver because he feared the “footage would misrepresent his connection with other artists whose style conflict with the one that he has developed.” However, his image appeared anyway in the opening of the show in December 2010.

According to the suit, “[Savely] understands that the reason many of the parents of the students he teaches employ his services is because they can trust him to provide their children with something more modern yet not corrupt.” However, Minaj “dresses provocatively, uses profanity and glorifies a specific lifestyle,” all of which is contrary to Savely’s more “conservative” image.
