It’s been reported that police in D.C., the city with the highest rate of HIV/AIDS in the country, are using possession of condoms as evidence of sex work.

And they’re not the only ones; New York and San Francisco have used safe-sex devices as a means for arrest, as well.

WTF? How can it be legal to punish, wrongfully label, and mar one’s public image all because he or she made a conscious decision, at some point, to do what they’ve probably been told their whole life?

I remember being told to abstain from sex. At least until marriage. And if I wasn’t planning on abstaining, I was supposed to use protection. And if I was to use protection, I wasn’t supposed to depend on the guy to bring it. Meaning I had to make the “walk of shame” to the nearest CVS myself, past the hair and body products, and into the family planning (or lack thereof) section. “Put your life into your own hands” – it was said and it was true. And then, unfortunately, in high school, someone mentioned that girls who carried condoms were “easy” and those that were easily influenced stopped using them and some got pregnant and some didn’t. (What definitely didn’t happen though were those girls becoming prostitutes but, I guess, that’s a minor oversight.)

There was a contradiction, though. Getting free condoms from the nurse was always an option, but never a rule. It was promoted, but looked down upon. READ MORE BELOW THE GALLERY!

And the same goes for the grand city of New York. It’s been distributing free condoms to combat STDs since 1971, but some businesses are even afraid to offer them because they can also be used as evidence of “maintaining a premises for prostitution.” In D.C., if caught carrying three or more condoms in a “Prostitution Free Zone,” you can be accused of intent to sell sex. But in San Francisco, police defended this practice by claiming that “a pocket full of condoms alone is not a basis for arrest.”

A basis for arrest? Should it be a factor at all?

I’m not condoning public sex – far from it. But a late night out, a single car ride somewhere, and a pocketful of condoms doesn’t always mean prostitution – maybe one hell of a night with no inhibitions and a happy ending, but not illegal sex.

    Carrying condoms means that you are smart having at least three is just logical,I would rather have some extra’s with me than to keep having to go to the store.

    I never thought New York would be one of the three picked on for arresting people for having condoms on them. Now why can’t men and women do the right thing without getting in trouble I guess they prefer to see people get AIDS and die. That must be the reason for arresting people in those three states that were mentioned. Carrying three condoms does not make you a prostitute it just makes you practice safe sex which is what we desperately need in this country to make people live longer than expected.

    LastManStandingTall, your comment was probably NOT the dumbest s**t I’ve ever read in my 31 years…buts its definitely battling for one of the top spots.

    Your ignorance is what continues to plague our communities. I feel for every kid who comes in contact with you and hope that they’re wise enough to see your example as the one NOT to follow.

    Now, I AM aware of the “you must have a lot of sex” mentality that men have whenever a woman has condoms. I think it speaks about the quality and self-respect of a woman to want to protect the health of herself and her mate. But hey, according to all the silly s**t I read on these websites, my chain of thinking stopped in the 80’s.

    Its almost a catch 22 nowadays though as anytime a MAN pulls out a condom, he has to hear the whole “oh you bought you a condom hunh? You just KNEW you were getting you some hunh?” It works both ways. Fortunately, we’re not being “locked up” for it. Thats the most ignorant thing I’ve ever heard.

    If they’re locking up women for having more than 3 condoms, what happens to the female who just walked to the local CVS and bought a box? I’m sure she’ll get 10 years off that alone!

    Ahem, Lastpersonstandingtall- SCRATCH! That men are not hoez azzezzment was so left field we cant even see you anymore! I think that anyone who has multiple partners or has sex with whomever they choose whenever they choose is not a hoe at all whether male or female. My perception of hoe was the people that have sex for money…If youre not doing it for money, youre just doing it for the pure pleasure then why call someone a hoe? They just ‘gettin it in’ if you ask me and more power to them if they are safe and not droppin kid bombs all over the place.

    Now as far as this three condoms equals prostitute bidness is ridiculous! So now ’safe’ is hooking? And the average cop, citizen whatever knows that usually a small pack of condoms comes in 3’s. That doesnt equate street walker, 3 condoms bought and used in the same night means BOTH people lucked up on a damn good night!

    I think that is crazy if anything authorities should be glad that people are being safe regardless of the fact of if they are engaging in illegal activity or not. Can’t say I’m really that surprised though I mean we live a society that is always getting the cow by the ass and always attacking the solution rather than taking a deeper look and combating the problem. Plus we live in a society that likes to profile people and prejudge people. It does show how shallow the authorities can be if they think just because a male or female has three or more condoms they are a prostitute. Thats like saying just because a person wears their pants a certain way or their hat a certain way they are in a gang.
