But, it’s not over, there is still issue to work out between Aubry, Halle and the L.A. Department of Children and Family Services, especially after Nahla told officials that she’s often frightened of her father, due to his outbursts of anger.

Aubry can only see his child under the supervision of a monitor, while Berry has petitioned a court to allow her to move to France with Nahla and fiance Olivier Martinez.

The website broke the story this morning that Halle wants to move to France and her baby daddy is not having it, but now that she’s engaged, the judge may look at her situation in a different light.

In California and most states, a judge would look at the stability of the parent’s relationship and a marital relationship is far more impressive than boyfriend and girlfriend.

No word on when the two will marry, but a marriage will DEFINITELY  take place! Smart move on your part Halle!

TMZ is reporting that Halle filed papers with the court requesting the move and the hearing is pending. Baby daddy Gabriel is pissed because he believes Halle is doing this to punish him and deprive him of having any contact with his baby girl. And to make matters worse Nahla will be living in another country with Halle’s new man Olivier Martinez.

Halle may be able to sway things in her favor, due to the fact that her stalker who has broken onto her property multiple times was just released from jail.

Is anyone thinking about what this could do to Nahla? Clearly this little girl loves her father, just look at the pics when they’re together.

According to TMZ, there have been no claims that Halle has mistreated the little girl, but a nanny is alleging that Gabriel pushed her once while holding the baby, as well as yanked the child out of her arms.

Naturally, Gabriel is asking for a restraining order against the nanny who he claims is making up stories.

This is so unfortunate! Nahla’s too young for her parents to be acting like children!

In her declaration, Kamdem also cited an incident in which she claims Gabriel violently pushed her out a door. Kamdem claims during a recent trip to Spain where Halle was shooting a movie:

Gabriel “would walk over and violently grab/take Nahla away from me.”

She also said Gabriel didn’t like her from the moment she began her duties as a nanny last June. She claims Gabriel said:

“You are a spy,” and “Nahla doesn’t like you, she doesn’t want you here.”

This is going straight to family court, not a good look for Gabriel!

Law enforcement sources tell TMZ, the confrontation supposedly happened last Wednesday, when the nanny went to his home after discovering he had kept three-year-old Nahla absent from nursery for two days due to illness.

The nanny then went to Gabriel’s home, where she found Nahla. The nanny picked Nahla up and began to question Gabriel as to why he didn’t take the child to school.

Gabriel allegedly flew into a rage and told the nanny:

“You’re the f**king nanny. Who do you think you are? You are a nobody. You don’t need to f**king know anything.” The 6-foot-4 Gabriel then allegedly pushed the 5-foot-2 nanny out the door, Nahla in her arms.

This is not looking good for Gabriel!

She called 911 and LAPD arrived, but it was too late. When house guests ran outside to confront him, he scaled the wall and fled.

Then on Sunday, Halle called 911 again. She was in her kitchen when she looked out the window and saw a man staring back at her, holding a book. Again, when police (with three cars and a helicopter!) arrived on the scene, the intruder was gone.

It is believed that that it was the same man; possibly a crazed fan trying to get an autograph or an ambitious paparazzi photographer.
