Drake Gets Sued By Playboy

Playboy Enterprises is reportedly suing Drake over the sampling of a track on “Best I Ever Had.” The lawsuit accuses Drake, Cash Money Records and Universal Music Group of Copyright Infringement.

The song sampled at the beginning of “Best I Ever Had” is allegedly their song, “Fallin’ In Love,” by Hamilton, Joe Frank and Dennison/Reynolds. The copyright for the music belongs to Playboy Music, Inc. and Plaintiff, Playboy Enterprises, is its successor in interest.

    Dont break people’s hearts. Some people have no idea what sampling is and think these rappers come up with these beat all by themself. Dont burst their bubble. Soon theyre gonna think that crappy Nicki Minaj song ‘Your Love’ is original.

    Actually the original was a bigger record than the drake song. However, I hope they sue the hell out of him and its nothing agains Drake as much as it is his stupid label.

    There wasn’t enough of the beginning of the song to even justify the suit. This is going to get tossed, depending on which state the case is decided in. Some states have laws which are very specific as to the length of the infraction (the sample) that constitutes copyright/sampling infringement. I heard it. The song Fallin’ In Love is nowhere as upbeat. The instrumentation is entirely different. The Drake song can easily survive without the .34 second sample of this song and still excel. Honestly, Hugh (Heffner), give it a rest. You look like you are ready to drop any minute anyway. You might drop by the time the suit is settled. Use the rest of your time in a more wise manner, like keeping your heart beating old boy.

    The songs and beat sound nothing alike instead of the first 10sec. “Best I Ever Had” was on a mixtape,i repeat was not an Album song it was on a mixtape, Mixtapes are no-profit( suppose to be). The legal money drake made off of that song was all from preforming,not the sale of that song youu cant sue for profit if there is no proof of profit being made off the song.. and this will get thrown out quick becuase a 10sec sample, which is only instruments isnt enough to claim that they infrindged on their copyright. YOU CANT COPYRIGHT 10SEC Of INSTRUMENT SOUNDS

    Check your law, you do not have to make profit in order to be sued. copyright infringement means unlawful use, copying, sampling, etc… without prior approval from the owner of the copyright. That is well known in the industry. Now, had he made a spoof of the entire song (parody) like 2-live crew did, then it would be all good. He is making money, pay the fee to use the sample. End of story. This is business not hating!

    As a producer myself, it never ceases to amaze how these new cats don’t seem to understand how sampling works. If you use somebody else’s stuff then you need to clear it if you’re going to put it out. It doesn’t matter how many seconds of it you used or if you made money off it or not. Intellectual property / copyright law is real clear on that so I guess if Birdman keeps making rookie mistakes like this then it won’t be Cash Money too much longer.

    Business is business, nothing personal. If average music fans know better, then Drake and his company should have known better!
    I’m sure if Drake, Cash Money and Universal Music Group, if they heard their music being played on a tv program or in a movie, they would check to see if that media was licensed to use their music, because they want to get paid from them using their music!
    Same thing with Playboy! You know these old corporations like Playboy is going to make sure they get/stay paid so they’ll come after young companies like Cash Money, cause it’s all about that “cream… dollar, dollar bill… y’all!!!!”
