A Mississippi Judge is seeing himself on the other side of the bench after allegations surfaced he attacked a disabled man nine months ago. Madison County Justice Court judge Bill Weisenberger who is white, is being accused of hitting and shouting “Run, n!$#%r, run” at a 20-year-old Eric Rivers, who is black and mentally disabled at a flea market on May 8. Weisenberger turned himself in last Thursday after a grand jury indicted him for simple assault on a vulnerable adult. According to the Jackson Clarion-Ledger the incident took place at a Canton, Miss flea market where Rivers was working as a parking attendant and traffic monitor, when Weisenberger hit him and yelled the offensive remark at him.

Weisenberger was released on $10,000 bond and if convicted will face a fine of $1,000, or up to 5 years in jail or both.  Weisenberger claims Rivers made rude remarks against his mother. The Attorney General’s office presented the case to four grand juries before it finally proceeded. There is no word on why it took so long for Weisenberger to be brought to justice and why he still receiving his annual salary of $45,700. He did finally have the sense to step down from the bench. The case is set to go to trial on June 8. In a press release, Attorney General Jim Hood stated:

The law does not discriminate, and the Grand Jury has given us our marching orders. We look forward to presenting the facts of this case in court.

Since Weisenberger’s case have been revealed, several claims of racial bias has come to light. Last year, he was accused of placing an illegal DUI sentence against a black person while they went before the judge. A lawsuit was also filed against Weisenberger in Novement where another black person had a fake charge of “roaming livestock” placed on them. The AG’s office is currently looking into the allegations.
