Los Angeles District Attorney Jackie Lacey recently issued a statement that former highway patrol officer Daniel Andrew will not face charges for brutally assaulting 51-year-old great-grandmother Marlene Pinnock.

“When looking at all of the evidence, and especially the medical reports and eyewitness accounts, it becomes exceedingly clear that the officer, who was alone and struggling with Ms. Pinnock precariously close to evening freeway traffic, acted within the law. In our analysis, his use of force was legal and necessary to protect not only his own life but also that of Ms. Pinnock,” read Lacey’s statement obtained by the LA Times.

Apparently, witnesses of the incident saw Pinnock hit the officer and they believed Andrew’s use of force was actually a life saving tactic to prevent the bipolar woman from walking into ongoing traffic.

“In our analysis, his use of force was legal and necessary to protect not only his own life but also that of Ms. Pinnock” said Lacey.

The decision comes over a year after the July 2014 incident when video footage of the beating went viral. In September, Pinnock was awarded a $1.5 million settlement with one of the terms being Andrew’s resignation. His last day as a CHP officer was December 1st.

Since the initial incident, Pinnock was arrested a second time for attempting to walk through traffic. Her family is now seeking treatment for her in a long-term care facility.
