Tracy Morgan Nabs Victory In Suit Against Wal-Mart

Comedian Tracy Morgan just landed a major win in his lawsuit surrounding the car accident which left him injured and a friend dead. Wal-Mart truck driver Kevin Roper tried to have Morgan’s suit against the retail chain delayed until his criminal case has ended, claiming he wouldn’t have a fair trial and would be on trial in Morgan’s civil suit. Roper has not been named in Morgan’s lawsuit.

According to  The JasmineBrand, a federal judge has denied his motion, and ruled Morgan’s lawsuit can proceed and also stated a delay in the case would unfairly affect Morgan’s suit. Judge Michael Shipp also ruled Roper didn’t produce evidence Morgan’s suit would ruin his ability to have an impartial trial, where he is being charged with vehicular homicide and assault.  On June 7 Roper was driving a Wal-Mart truck which slammed into Morgan’s limo where he was severely injured and his friend and fellow comic James McNair was killed. Morgan sued Wal-Mart for allowing Roper to drive for 10 hours straight after he was reportedly awake for more than 24 hours.
