Theodore Wafer’s attorney is seeking a short six-year prison sentence after he fatally shot Renisha McBride on his porch, as she was asking for help after crashing her car. The prosecutors are said to be seeking a minimum of 17 years. Is it just me, or does this sound like a slap on the wrist, compared to what he’s done to McBride and her family? Maybe it’s because I think a murderer doesn’t need to ever go free…?
Defense attorney, Cheryl Carpenter presented her own 12-page filing earlier this week, urging Hathaway to go below the guidelines and sentence Wafer to as few as six years in prison, including two for the gun charge. Is she serious? Oh, it gets worse! “The facts and circumstances of this case are more akin to manslaughter than murder,” Carpenter said. “It does not seem fair or just that a person who does not intend to kill another person is convicted of murder.”
So now Wafer’s not considered a murderer after he shot Renisha in the head because she was asking for help? Right. When Wafer shot Renisha, he insisted that it self-defense because he found her on his porch, pounding on the door at 4:30 a.m. But the jury didn’t buy his self-defense claim because of his conflicting confessions: 1) He didn’t know the gun was loaded. 2) He pulled the trigger because he feared his life.
Wafer returns to court next Wednesday, about a month after he was convicted of second-degree murder, manslaughter and a felony firearm charge in the shooting of McBride. Reports say that McBride’s murder calls for a minimum punishment anywhere between 15 and 25 years in prison. These guidelines are said to be enhanced because Wafer was charged with manslaughter.
Assistant prosecutor, Athina Siringas said, “There are no compelling, objective and verifiable reasons … that would justify a downward departure from the guideline range.” Let’s hope!
Wafer could be released by the Michigan parole board after he serves whatever minimum sentence is ordered by Judge Dana Hathaway.
